Contract *

A. Entire Agreement The laws of England and Wales shall govern this agreement. This agreement contains the entire understanding between Candid You Photography and the client (named above). It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties. B. Fees Client agrees to pay photographer a sum of £25 at the time of downloading any pictures taken during this session. By definition it does not include any physical prints. These need to be purchased separately. C. Location Costs & Fees If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. D. Style Client has reviewed the photographer’s online portfolio and is aware of her artistic style. Client is aware that her style is "lifestyle" meaning that no poses or arrangements are guaranteed. E. Re-shoots / Refunds Due to the custom nature of the services being provided, there are no refunds or returns. F. Archive After three (3) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. G. Payment All payments are due in full unless other payment arrangements have been made in writing. In case of orders for any physical product, orders will not be processed until payment in full is received. H. Damage Photographer is not responsible for the damage of portraits after delivery to client. Client assumes all responsibility for the safety of all portraits upon receipt. I. Privacy Policy By signing this contract you confirm that you have read, understood and agree to Candid You Photography's Privacy Policy. The Privacy Policy can be found on the footer of this website on every page. J. Liability Client is aware that any pose suggested by Candid You Photography is merely a suggestion. Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. Candid You Photography takes the utmost care with respect to the exposure and retouching of digital captures. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received for this particular shoot, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. K. Copyright & Penalty Candid You Photography retains all copyrights to all images created during client’s session. A print release is made available with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Candid You Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. L. Prints and Products Client is aware that if he/she chooses to order any prints, he/she will need to pick up the products from Candid You Photography address in Harborne, Birmingham. M. Returns Policy Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Faulty items should be posted to Candid You Photography’s Harborne, Birmingham address. The Client is responsible for any costs associated with return postage. Returns will not be considered for incorrectly ordered items or items ordered in error.
