(Please note that I will make every effort to choose one of these dates. However, there are no guarantees. If all three dates are taken, then I will find another date per your convenience)
A. Entire Agreement
The laws of England and Wales shall govern this agreement. This agreement contains the entire understanding between Candid You Photography and the client (named above). It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties.
B. Session Fees
Client agrees to pay photographer a deposit of 50% at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session. The remaining balance 50% is due at the time of the session. The session fee covers the time and talent of photographer. By definition it does not include any product, either digital or physical prints. These need to be purchased separately.
C. Location Costs & Fees
If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Creative fee covers travel within 10 miles of Birmingham, UK. Any location outside of these limits will be subject to an additional charge of £.50/mile as part of the agreement.
Client has reviewed the photographer’s online portfolio and is aware of her artistic style. Client is aware that her style is "lifestyle" meaning that no poses or arrangements are guaranteed.
If illness or injury prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours’ notice, or decide to completely cancel the session, the retainer is forfeited and will not be refunded. Rescheduling due to inclement weather is at the sole discretion of the photographer. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
F. Re-shoots / Refunds
Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer. Due to the custom nature of the services being provided, there are no refunds or returns.
After three (3) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
All payments are due in full unless other payment arrangements have been made in writing. Orders will not be processed until payment in full is received.
Photographer is not responsible for the damage of portraits after delivery to client. Client assumes all responsibility for the safety of all portraits upon receipt.
Client gives permission to Candid You Photography to use this session’s photos and likeness in all forms and media for blogging, online sharing, portfolio, advertising, demo, stock photography, editorial, altering without restrictions, and all other lawful purposes. Client understands that he/she will not be entitled to any compensation. He/she releases Candid you Photography from all forms of claims and liability related to photo usage from this session’s photos.
Client is aware that any pose suggested by Candid You Photography is merely a suggestion. Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. Candid You Photography takes the utmost care with respect to the exposure and retouching of digital captures. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
L. Copyright & Penalty
Candid You Photography retains all copyrights to all images created during client’s session. A print release is made available with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Candid You Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images.
M. Prints and Products
Client must place any orders for products at the Ordering and Viewing session. Client is aware that if he/she chooses to order any prints, he/she will need to pick up the products from Candid You Photography address in Harborne, Birmingham.
N. Returns Policy
Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Faulty items should be posted to Candid You Photography’s Harborne, Birmingham address. The Client is responsible for any costs associated with return postage. Returns will not be considered for incorrectly ordered items or items ordered in error.
